Due to the increased number of complaints of children being shot with Orbeez guns in Dayton, Kentucky, and with the possibility of serious injuries occurring, Dayton Mayor Ben Baker has drafted an executive order.

The order prohibits the use of weapons Orbeez or water pellet guns, pellet, BB and paint ball guns in the city parks, public sidewalks and rights-of-ways.

“I, Ben Baker, Mayor of Dayton Ky., pursuant to powers vested in me by KRS 83A.130 and section 95.40(G) of the Dayton Code of Ordinances, hereby establish the following:

“The use of splatter guns, also known as Orbeez or water pellet guns, pellet, BB, and paint ball guns in city parks is ‘prohibited conduct’ under section 95.40 of the Dayton Code of Ordinances and the use of these weapons on public sidewalks and other public right-of-way, which causes bodily injury to individuals, violates Chapter 508 of the Kentucky Penal Code and that individuals using these weapons in this manner are violating city ordinances and/or state law may be charged accordingly.”

The executive order also said that the Campbell County District Court has ruled that the use of these weapons on third parties that results in bodily injury to those persons is “wanton endangerment” under the Kentucky Penal Code.
